DMA workshop - Applying the DMA’s ban on self-preferencing: how to do it in practice?

On 5 December 2022, the European Commission will host a first technical workshop on the effective implementation of Regulation (EU) 2022/1925, the Digital Markets Act.

The Digital Markets Act was published in the Official Journal on 12 October 2022 and will enter into force on 1 November 2022. It is the first global regulation aiming to ensure fair and contestable markets in the digital sector. As we now move into the implementation phase, the Commission believes it important for all stakeholders to provide their input and views on various implementation questions, whilst fully respecting the letter and the spirit of the Digital Markets Act.

The view of third parties, including but not exclusively of those who are potential beneficiaries of the Digital Markets Act, will be an important input in ensuring practicable, transparent and effective compliance solutions.

The European Commission has the pleasure to open the registration for the technical workshop on:

Framework of the workshop and practical issues

Following the introductory remarks by the Commission, there will be several panels on specific practical questions related to compliance. These include the identification of practices amounting to self-preferencing, detecting the existence of self-preferencing practices and concrete measures to ensure and monitor compliance with Article 6(5) DMA.

In each panel, these issues will be briefly introduced by selected panel members before opening an all-inclusive discussion between all participants present physically or online. To facilitate the hybrid discussion, sli.do will be used to collect and select questions from the audience. This will also allow the Commission to take account of issues that may have been raised, but could not be addressed in the workshop due to time constraints.

The discussion during the workshop will be based on the exchange of non-confidential information and should not include any sensitive business information, since the workshop is open also to the public.

Registrations to attend the workshop online will close on Friday 25 November 2022 at 4pm.

Participants having registered to attend the workshop in person will be informed whether their request can be accommodated by Friday 25 November 2022 COB. If their request cannot be accommodated, they will automatically be registered to attend online. All participants having registered to attend the workshop online will receive a link to connect to the workshop’s webstream by Friday 25 November COB.

The workshop will take place in English. No interpretation will be provided.
